A Michigan man was perfectly within his rights when he was open carrying a pistol in Grand Rapids, Michigan. But apparently not everyone in Michigan is aware that this is a legal activity.
A 911 caller was very disturbed by the sight of the open carrier and was shocked to hear that this was legal activity. Listen to the 911 call in the video at the bottom of this post.
“Well, you’ll probably see more and more of it. Since all the school shootings and such, people are exercising their open-carry (rights),” the dispatcher said.
But after the phone call the situation did not end there. After the call the dispatcher sent two police officers to check out the suspicious person who was open carrying. The carrier, Johann Deffert (28), was reportedly talking loudly outside of a church service.
Deffert was ordered to the ground at gunpoint when the officers arrived. Officer William Moe said his actions were warranted considering the situation.
“Deffert was alone, and was loudly talking to himself,” Moe wrote. “Based on the area, and Deffert’s unusual behavior, R/O (responding officer) was concerned Deffert may have mental issues and was about to commit a violent crime.”
However, Deffert did NOT have any mental health issues and did not have a criminal record. Deffert’s attorney said his client was singing and talking as he walked down the street, and so far that is not a crime in the state of Michigan.
Deffert has filed a lawsuit against the Grand Rapids police department saying that the police violated his constitutional rights and falsely detained him. Deffert says his reason for open carrying was partly to help increase awareness on the legality of open carrying handguns and the lawsuit will help educate Michigan residents on their rights as well.
