Here is a perfect example of all the gun laws allowing a criminal to walk free in spite of being caught jaywalking with 30 bags of weed and an illegal weapon in his possession. Yet we as law abiding citizens get the book of the law thrown at us while they are trying to tell us where we can and cannot carry.
The police in Chicago (where some of the strictest gun laws exist) stopped Dwight Robinson for a simple jaywalking charge. It quickly turned into something more after the police found more than 30 bags of marijuana and a gun on his person. Because Dwight had a felony he can’t have a gun. Obviously that did not stop him.
He should have gotten a lifetime prison sentence for drug trafficking alone, but that is where the technicality of this crazy case comes into play. It all started when the police stopped him for jaywalking when they found the drugs and gun. If they hadn’t stopped him for jaywalking they never would have found the rest.
“My client crossed the street,” said attorney Andrew Densemo. “He walked across the street. The ordinance says in order to be guilty of the violation, you have to impede vehicular traffic,” Densemo said. “My client crossed the street in a matter of two seconds.”
According to Fox32 he’s right. “The ticket said Robinson violated section 55-12-3. And when you look at that section it says that the pedestrian must step into the path of a motor vehicle constituting a hazard.”
FOX 2: “Your client had 30 bags of Marijuana and a gun on him, what happened to that?”
“There was a Constitutional violation, which superseded the criminal violation,” Densemo said.
Translation, Dwight Robinson wasn’t technically jaywalking, The cops shouldn’t have searched him, and the drugs and gun, shouldn’t have been found.
FOX 2: “Some would say your client got off on a technicality.”
“No my client got off because the Constitution says that the laws have to be respected,” Densemo said. “And the lesson you learn is that the rights of citizens can still be protected by the best legal system in the world.”
The Constitution saved this man in the words of his attorney. They same one which has a Second Amendment which gives us every right to carry legally every where we go. So this criminal gets to walk free, while we can not carry freely. Welcome to the law of the liberal friends.
