Rather than try to pass gun laws through congress, President Obama has decided to use his executive powers to push gun control legislation into the books.
This move has been met with disdain on both sides of the political aisle and now the first lawsuit has been levied against the administration.
President Obama’s moves set forth a very dangerous precedent for future presidents who may also be tempted to use executive actions on any political agenda rather than let the country’s representatives vote.
According to thehill.com,
On the same day the Supreme Court agreed to hear a challenge to Obama’s action on immigration, the conservative advocacy group Freedom Watch announced it is filing a lawsuit against the controversial gun orders.
Freedom Watch accuses Obama of circumventing Congress to “invent” new gun laws.
“The president states that he is doing so purely because he does not like the legislative decisions of the Congress,” wrote Larry Klayman, the founder of Freedom Watch, who is also a National Rifle Association member.
“These actions are unconstitutional abuses of the president’s and executive branch’s role in our nation’s constitutional architecture and exceed the powers of the president as set forth in the U.S. Constitution,” he continued.
This is believed to be the first in what is expected to become a series of legal challenges over Obama’s gun orders. But many legal experts predict the executive action will prevail.
The president announced the gun orders two weeks ago as part of a major push by his administration to crack down on gun violence across the country.
As part of the executive action, more gun dealers will be required to conduct background checks.
Freedom Watch argues the Obama administration is illegally redefining the nation’s gun laws.
The lawsuit was filed in the U.S. District Court for the Southern District of Florida. In addition to Obama, it also names as defendants Attorney General Loretta Lynch and Thomas Brandon, director of the Bureau of Alcohol, Tobacco, Firearms and Explosives.
